Belgium’s 300 kg figure must be read alongside the specific duty it qualifies. Separate take-back from reporting, producer registration and representation before deciding what a small seller must do.
Which duty uses the 300 kg figure?
The Interregional Packaging Commission’s take-back guidance describes companies placing more than 300 kg of household and industrial/commercial packaging on the Belgian market per year. This is a take-back threshold, not a general exemption from every packaging duty. Its wording combines those packaging categories; do not test them as separate allowances.
Reporting is a separate question
The Commission has a separate reporting page covering companies placing packaged products on the Belgian market. Keep an explicit reporting decision in your file, even when your calculation is below the take-back threshold. Confirm the responsible entity, reporting route and evidence for your circumstances rather than inferring the answer from weight alone.
How do registration and representation fit?
Fost Plus’s September 2026 practical guidance says producers must register with the Belgian producer register and describes representation for non-Belgian companies without a Belgian establishment. It does not present the 300 kg take-back threshold as an exemption from that process. Check your producer role and the actual registration route with the relevant body. A Fost Plus membership reference, registry confirmation and representative mandate serve different purposes.
Calculate a complete Belgian total
Prepare an annual worksheet by legal entity and destination country. List packaging components, material, unit weight and the quantity relevant to the assessment. For example, 250 kg of household packaging plus 80 kg of industrial/commercial packaging produces a combined 330 kg total. The example illustrates aggregation only; it does not decide who is legally responsible for those quantities. Keep source weights and sales records so the calculation can be checked.
Do not confuse kilograms with tonnes
The prevention-plan figures on Fost Plus’s membership page refer to much larger tonnage thresholds and different activities. They are not the same as the 300 kg take-back test. Label each rule in your assessment with its unit, activity, period and responsible party. If your calculated total is exactly at a boundary or your packaging classification is uncertain, seek a written answer on that point.
What to send for a scoped assessment
Share the legal seller, establishment, sales routes, Belgian packaging worksheet, existing memberships and registration evidence.
